Our General Terms and Conditions of Business:
1. General Terms and Conditions
The General Terms and Conditions of Business apply to the hiring of accommodation as well as to all other goods and services associated therewith. Registration is deemed to have been completed as soon as the accommodation has been reserved or the request for accommodation has been confirmed or, or, if time does not permit such confirmation, as soon as the accommodation has been made available.
2. Registration
Each customer /guest must complete the registration procedure. Each customer/guest must be a natural person of unrestricted legal capacity over the age of 18 years, a legal entity or a company conducting business in the sense conveyed by § 6 of the German Commercial Code (HGB). All rights to a legal claim to registration are hereby excluded. The Hotel Mirabell reserves the right to refuse to accept the registration and to cancel a registration without any legal obligation to furnish a reason for such action. In particular this shall apply if the customer/guest provides on registration any information that is untrue or there has been a repeated breach of these Terms and Conditions. In such an instance the customer/guest may not present any legal claim. The data provided by the customer/guest shall be used solely in connection with and for whatever purposes that may be required to process the reservation.
3. Services
3.1 The Hotel is obliged to provide those services requested by the customer/guest and agreed to by the Hotel.
3.2 The customer/ guest is obliged to pay the agreed price or the usual price charged by the Hotel for these services and any further services that may be utilised. The same shall also apply to services requested by the customer/guest and to whatever sums the Hotel may have paid to a Third Party for the provision thereof.
3.3 The Hotel reserves the right to demand at any time a commensurate amount in advance payment. The amount and the date by which such a payment is to be made may be agreed to in writing in the Contract.
4. Room Prices
The current daily rates are per night and per room and include VAT and breakfast. This shall not apply in the case of the prices charged for special weekend arrangements. Such arrangements shall be charged per person and per night and the price quoted shall include VAT, Breakfast and any tickets that are obtained on behalf of the customer/guest shall be charged for separately.
5. Non-arrival
All reservations will be held until 18:00, unless other prior arrangements have been made. Under any circumstances the Hotel should be informed in advance of a later check-in time. If the Hotel has not been informed, there shall be no further right to the accommodation after 18.00.
6. Cancellation
If a room reservation is cancelled prior to arrival at the Hotel, there shall be a time limit of 48 hours prior to the date of arrival; during trade fairs and the annual 'Oktoberfest' a cancellation must be made at least one week in advance, unless the Hotel and the customer/guest have made different prior arrangements. If the allotted period for a cancellation has elapsed, 100% of the price that would otherwise be incurred will fall due, unless the accommodation is otherwise occupied. The same conditions shall apply to the hiring of conference rooms. A cancellation must be made in writing.
7. Cancellation by the Hotel
If the agreed advance payment has not been paid within the allotted period, the Hotel reserves the right to cancel the Contract. In addition, the Hotel also reserves the right to withdraw from the Contract for justifiable cause, for example in the case of force majeure or for other reasons for which the Hotel cannot be held responsible and which render it impossible to comply with the terms and conditions of the Contract, or if an event is organised on the basis of misleading or false information regarding important facts. In the case of justifiable cancellation on the part of the Hotel, the customer shall have no right to present a claim for damages.
8. Payment
All bills presented by the Hotel shall be settled in full within 10 days of receipt and without any deductions. If payment is not made promptly, the Hotel reserves the right to demand the currently valid defaulted payment interest or, in the case of legal transactions involving an ultimate consumer, amounting to 5% above the base rate. The Hotel reserves the right to present evidence of greater damage to the Hotel and its business.
9. Check-in /Check-out
On the day of arrival the reserved accommodation will be available from 14.00. On the day of departure the accommodation is to be vacated by 11.00 at the latest. If the customer/guest has not given the Hotel prior information on departure date and time, this information must be given by 09.00.
10. Valuables
Hotel liability for valuables shall exist within the provisions of the legal requirements specified in §107 et seq. of the German Civil Code (BGB). There are a number of safes at reception in which guests may deposit valuables for safe keeping.
11. Final clause
The place of performance and venue for both Parties is Munich. All issues arising from this Contract shall be subject to German Law. On the basis of the signature appended to the Contract / receipt of a copy thereof you accept at the same time the Terms and Conditions of this Contract.
